This website is operated by Heemer Crafted Inc. Throughout the site, the terms “we”, “us”, and “our” refer to Heemer Crafted Inc. Heemer Crafted offers this website, including all information, tools, products, and services available from this site, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By accessing our website, requesting a quote, or purchasing any product or service from us, you agree to be bound by these Terms of Service (“Terms”). These Terms apply to all users of the site, including browsers, customers, vendors, and contributors of content.
If you do not agree to these Terms, you may not access the website or use our services.
Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services.
DEFINITIONS
Standard Products
Products sold through our online store without customization.
Custom Products
Products that are built, modified, or fabricated to customer specifications, including but not limited to custom dimensions, finishes, artwork, electrical configurations, controls, or integration requirements.
ORDERS, QUOTES, AND PAYMENTS
Quotes provided by Heemer Crafted Inc. are valid for 14 days unless otherwise stated in writing. Pricing, lead times, and availability may change after this period.
Custom Products typically require a non-refundable deposit prior to the start of fabrication. The remaining balance is due prior to shipment unless otherwise agreed in writing.
We reserve the right to refuse or cancel any order at our discretion.
CUSTOM FABRICATION TERMS
Due to the custom nature of fabricated products, Custom Products are not eligible for return or refund once fabrication has begun, except in cases of defect or error directly attributable to Heemer Crafted Inc.
Any changes requested after fabrication has started may result in additional costs and revised lead times. All change requests must be approved in writing.
Lead times provided for Custom Products are estimates only and may vary due to material availability, supplier delays, or other factors beyond our control.
STANDARD PRODUCT RETURNS
Standard Products may be returned within 30 days of delivery, provided they are unused, uninstalled, and returned in original condition and packaging.
Refunds for Standard Products are subject to a 20% restocking fee. Return shipping and any associated costs are the responsibility of the buyer.
Custom Products are not eligible for return under this policy.
SHIPPING AND DAMAGE
All shipments must be inspected upon delivery. Any shipping damage must be reported to Heemer Crafted Inc. within 48 hours of receipt. Failure to report damage within this timeframe may void any claim.
Heemer Crafted Inc. is not responsible for damage caused during installation, improper handling, misuse, vandalism, or use outside of intended operating conditions.
WARRANTY
Heemer Crafted Inc. warrants that its products will be free from defects in materials and workmanship for a period of 90 days from the date of delivery.
This warranty does not cover normal wear and tear, misuse, abuse, vandalism, environmental exposure beyond design specifications, improper installation, or modifications made by others.
USE OF PRODUCTS
You agree to use all products in compliance with applicable laws, safety standards, and intended use guidelines. Heemer Crafted Inc. is not responsible for injuries, damages, or losses resulting from improper use or installation.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Heemer Crafted Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our products or services.
Our total liability shall not exceed the amount paid for the product or service giving rise to the claim.
GOVERNING LAW
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
CHANGES TO TERMS
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to this page. Continued use of the website or services constitutes acceptance of the updated Terms.
